AGSA Eligibility Determination

  1. Butte County has land use authority except for areas within the jurisdictional boundaries of local municipalities (e.g., Cities of Chico, Biggs, Gridley, Oroville and Paradise). Butte County has flood management authority and water supply responsibility through its State Water Project Contract. Butte County has an adopted Groundwater Management Plan for the portions of the county.

  4. Butte County elected to be a GSA prior to enactment of SB13. Action was taken to remove the overlap with other agencies by retracting the Butte County GSA boundary. The action take by Butte County is not a material change to the original notice and filing. A portion of the East Butte subbasin (Thermalito Afterbay) was included as part of the GSA area of a number of other local agencies. As indicated by the SWRCB, this does not constitute an overlap since local agencies cannot manage outside of their jurisdictional boundaries. The SWRCB views the Thermalito Afterbay as the exclusive GSA area of Butte County. Butte County modified its service area in East Butte by removing the portions that became part of the Wyandotte Creek subbasin.   3. Butte County GSA covers areas not served by other GSAs in the East Butte subbasin. Resolution 17-085 modifies the Butte County GSA boundary to remove the overlap with other GSAs in the East Butte subbasin. Butte County has taken explicit action to remove the overlap of the jurisdictional boundaries of other agencies in the subbasin. However, some areas on the GIS viewer may show overlap. Any overlap reflected in the GIS viewer is not intentional and due to technical differences in the respective shapefiles filed by the agencies. The agencies are committed to resolve the technical issue. The Butte County GSA service area in the East Butte subbasin was modified to remove the portions that are part of the Wyandotte Creek subbasin.
