AGSA Eligibility Determination

  1. Pursuant to Water Code Section 10723.8, the County of San Luis Obispo hereby notifies the California Department of Water Resources (DWR) of its decision to become a Groundwater Sustainability Agency (GSA), and its intent to cover a portion of the San Luis Obispo Valley Basin (Basin) within the County's jurisdictional limits that are otherwise unrepresented by another GSA. This notice is submitted in compliance with Water Code Section 10723(d). The County of San Luis Obispo is a local public agency organized as a general law County under the State Constitution and has land use responsibility for the unincorporated areas of the Basin proposed to be managed under this GSA.

  3. The County intends to be the GSA over a portion of the Basin that is otherwise unrepresented by another qualifying local agency and is located within the County's jurisdictional limits. It is the County's intention that no overlap shall occur in the Basin between the San Luis Obispo Valley Basin - County of San Luis Obispo Groundwater Sustainability Agency and the other GSA(s) forming in the Basin. Prior to its decision to become a GSA for the specific portions of the Basin, the County Board of Supervisors held a properly noticed public hearing on May 23, 2017. The public hearing was held in accordance with Water Code section 10723(b), and it was noticed on May 9th and 16th, 2017 in the local Tribune Newspaper in accordance with Government Code section 6066. On August 24, 2021, the County Board of Supervisors held another public hearing, authorized certain changes to the GSA Boundary reflecting annexations to the City of San Luis Obispo, and found the changes non-material.   2. The City of San Luis Obispo is the only other agency in the Basin that is in the process of forming a GSA to manage groundwater within its jurisdictional boundary. The County of San Luis Obispo is coordinating with the City and other local entities that overlie the Basin and intends to work cooperatively with these entities to jointly manage groundwater in the Basin.
