AGSA Eligibility Determination

  1. RESOLVED, by the Board of Trustees (the "Board") of Reclamation District No. 1001 (the "District"), County of Sutter and County of Placer, State of California, that WHEREAS, the Sustainable Groundwater Management Act of 2014 went into effect on January 1, 2015; and WHEREAS, the Sustainable Groundwater Management Act of 2014 enables the State Water Resources Control Board to intervene in groundwater basins unless a local public agency or combination of local public agencies form a Groundwater Sustainability Agency or Agencies (GSA) by June 30, 2017 (Water Code §10735); and WHEREAS, retaining local jurisdiction over water management and land use is essential to sustainably manage groundwater within the District, and WHEREAS, any local public agency that has water supply, water management or land use responsibilities within a subbasin may elect to be a Groundwater Sustainability Agency (Water Code §10721 and §10723(a)); and WHEREAS, the District is eligible and presumed to be a Groundwater Sustainability Agency for the portions of the North American subbasin within the District not represented by South Sutter Water District GSA or Placer County GSA; and WHEREAS, other local public agencies in the District have elected to be a GSA and have notified the Department of Water Resources of their intent to undertake sustainable groundwater management; and WHEREAS, within 90-days of an entity giving notice to the Department of Water Resources of the intent to form, or having formed, a GSA, that entity shall be presumed to be the exclusive GSA for that area unless another entity provides notice to the Department of Water Resources of their intent to form, or notice that the entity formed, a GSA (Water Code §10723.8); and WHEREAS, establishing the District as a Groundwater Sustainability Agency will enable the District to work with other GSAs in the preparation and implementation of an effective and mutually beneficial Groundwater Sustainability Plan(s) for the sustainable groundwater management in District; and WHEREAS, The District intends to work cooperatively with other local public agencies to manage the above-mentioned groundwater basins in a sustainable fashion; and WHEREAS, adoption of this Resolution does not constitute a ?Project? under the California Environmental Quality Act (CEQA) pursuant to Sections 15378(a) and (b) of Title 14 of the California Code of regulations because this Resolution does not result in a direct or indirect physical change in the environment; and WHEREAS, the Board of Directors held a public hearing on this date and after publication of notice pursuant to Government Code section 6066 to consider the election to become a GSA. NOW, THEREFORE, BE IT RESOLVED, that the Board of Trustees of Reclamation District 1001 hereby elects to become a Groundwater Sustainability Agency for the portions of the District that overlie the North American subbasin as depicted by the Department of Water Resources Bulletin 118 (Update 2003) and that are not represented by South Sutter Water District GSA or Placer County GSA. BE IT FURTHER RESOLVED that within thirty days of this date, the District staff is directed to provide notice of this election and intent to undertake sustainable groundwater management for the above-mentioned subbasin to the Department of Water Resources in a manner required by law. BE IT FURTHER RESOLVED that the District staff shall continue discussions with other local public agencies in order to begin the process of developing a groundwater sustainability plan(s) for the above-mentioned subbasin that underlie the District and surrounding areas.

  1. The GSA has and will continue to closely work with landowners to make sure their needs are met. The GSA area is primarily agriculture and as such farmers make up the bulk of the land owners. However, we will also take into consideration domestic well owners, environmental users, surface water users, and any California Native Tribe's issues or needs as per Water Code Section 10723.2. As the area's land owners may change the GSA will need to adapt with the change in land owners. The GSA has already reached out to land owners via USPS and has personally met with many as well as noticing the GSA formation. As this process continues takes shape the GSA will continue to take all comments and issues into consideration when making decisions or policy.
