AGSA Eligibility Determination

  1. Yuba County Water Agency (?YCWA") is authorized under the Yuba County Water Agency Act (Water Code Appendix, ch. 84) to, among other things, store, conserve, and reclaim water; appropriate and acquire water and water rights; prevent the wasteful use of water within its boundaries; prevent the interference with or diminution of, or declare rights in, the natural flow of any stream or surface or subterranean supply of waters used by YCWA; prevent the unlawful exportation, pollution, and contamination of surface and subsurface water; and is empowered to do any and every lawful act necessary to ensure that sufficient water is available for present and future beneficial uses of the lands within Yuba County (Water Code Appendix §§ 84-4, 84-4.3); YCWA overlies much of the North Yuba, South Yuba, and Wyandotte Creek Subbasins of the Sacramento Valley Groundwater Basin (Department of Water Resources Basin Nos. 5-21.60, 5-21.61, and 5-021.69) and is already implementing a comprehensive program to monitor and sustainably manage these subbasins.

  5. The original GSA boundary, submitted in a letter to DWR dated August 11, 2015, was defined as the DWR Bulletin 118 groundwater basins within the YWA service area. DWR, through the basin boundary modification process, changed the boundaries of the South Yuba Subbasin. This May 2017 modification is submitted to allow the GSA boundary to continue to meet the original intent of covering the DWR Bulletin 118 groundwater basins within the YWA service area. The action taken by YWA is not a material change to the original notice and filing. Similarly, this April 2019 modification is submitted to allow the GSA boundary to continue to meet the original intent of covering the DWR Bulletin 118 groundwater basins within the YWA service area, as recent basin boundary modifications have occurred. The action taken by YWA is not a material change to the original notice and filing.

  2. At the time of submittal, Butte County and the City of Oroville have filed to become GSAs for the Wyandotte Creek Subbasin. Also at the time of submittal, Cordua Irrigation District and the City of Marysville have filed to become GSAs for the North Yuba Subbain. No other GSAs are present within the South Yuba Subbasin. YCWA intends to work cooperatively with other agencies to manage the Wyandotte and North Yuba Subbasins, to the extent required and necessary. Further, YCWA intends to work within future basin boundary modification processes to resolve very small unmanaged areas.
