For over 100 years, Alameda County Water District (ACWD) has managed the groundwater of the Niles Cone Groundwater Basin through programs that protect and improve water supplies for all groundwater users and the environment. Per SGMA, Sustainable Groundwater Management means the management and use of groundwater in a manner that can be maintained during the planning and implementation horizon without causing undesirable results. SGMA defines undesirable results as chronic lowering of groundwater levels, reduction of groundwater storage, seawater intrusion, degraded water quality, land subsidence, and depletions of interconnected surface water. ACWD has in place an existing plan developed pursuant to laws authorizing groundwater management, specifically the County Water District Law (Water Code § 30000 et seq.), the Replenishment Assessment Act of the Alameda County Water District (Chapter 1942 of the Statutes of 1961, as amended in 1970 and 1974), and the Alameda County Water District Groundwater Protection Act (§ 31142.20 et seq.). Under these laws, ACWD has a number of planning and operational documents and policys under which ACWD manages the Niles Cone Subbasin 2-09.01 (Niles Cone). As early as 1920, ACWD began to impound winter flows in Alameda Creek to increase groundwater recharge in the Niles Cone; and since 1962, ACWD has been engaged in a continuous water replenishment/recharge program in order to sustainably manage the quality and quantity of the water of the Niles Cone. In addition, ACWD has an analysis of basin conditions that demonstrates the Niles Cone has operated within its sustainable yield over a period of at least 10 years. ACWDs annual Survey Report on Groundwater Conditions and Groundwater Monitoring Report support this analysis. On December 8, 2016, ACWDs Board of Directors adopted Resolution No. 16-075 authorizing the submittal of an Alternative to a Groundwater Sustainability Plan for Niles Cone Subbasin 2-09.01. ACWDs Alternative to a Groundwater Sustainability Plan (Alternative to a GSP) preserves and continues the successful sustainable groundwater management already being performed by ACWD. This would be accomplished by continuing groundwater management under pre-existing authority by which the District carries out groundwater management efforts within Niles Cone Subbasin 2-09.01, in addition to the authorities of a Groundwater Sustainability Agency under SGMA. ACWDs Alternative to a GSP submittal will also include an explanation of how the Alternative to a GSP is functionally equivalent to elements of a Groundwater Sustainability Plan and achieves the objectives of SGMA. ACWD has provided the December 8, 2016, Board of Directors meeting agenda, staff report, presentation materials, and Resolution No. 16-075. The Board of Directors meeting minutes are not available until after the submission is due. Additional information, including public outreach for the Replenishment Assessment, is also provided in the Alternative Elements Guide, Section 354.10, Notice and Communication.

  2. An analysis of basin conditions that demonstrates that the basin has operated within its sustainable yield over a period of at least 10 years.

    Alameda County Water District (ACWD) manages the Niles Cone Subbasin 2-09.01 (Niles Cone) pursuant to its statutory authority under County Water District Law (Water Code §30000 et seq.), the Replenishment Assessment Act of Alameda County Water District (Chapter 1942 of the Statutes of 1961, as amended in 1970 and 1974), and the Alameda County Water District Groundwater Protection Act (§ 31142.20 et seq.). Under these laws, ACWD has a number of planning and operational documents and policys under which ACWD manages the Niles Cone. However, there are three documents which are considered to be core to the sustainable management of the Niles Cone. These core documents are the: (1) the Groundwater Management Policy (Policy), which was adopted in 1989, and last amended in 2001; (2) the annual Survey Report on Groundwater Conditions; and (3) the annual Groundwater Monitoring Report. The programs under the Policy include water supply management, groundwater replenishment, watershed protection and monitoring, groundwater basin monitoring, wellhead protection, aquifer reclamation, groundwater protection, and well ordinance administration. The purpose of which is to protect and improve groundwater resources for the benefit for all users of the groundwater basin and the environment by taking actions designed to meet the following objectives, as identified in the Policy: 1) Increase groundwater replenishment capability; 2) Increase the usable storage capacity of the groundwater basin; 3) Operate the basin to provide: A) A reliable water supply to meet baseload and peak distribution system demands, B) An emergency source of supply, and 3) Reserve storage to augment dry year supplies; 4) Protect groundwater quality from degradation from any and all sources including: saline water intrusion, wastewater discharges, recycled water use, urban and agricultural runoff, or chemical contamination; 5) Improve groundwater quality by: A) Removing salts and other contaminants from affected areas of the basin, and B) Improving the water quality of source water used for groundwater recharge. Since ACWD has been monitoring the Niles Cone since its formation in 1914, a variety of monitoring programs have been implemented and modified over time due to historical groundwater management needs, specific related studies, compliance with water rights reporting, and direction of the ACWD Board of Directors. ACWDs annual Groundwater Monitoring Report provides information collected during the Spring/Fall Groundwater Monitoring Programs, which includes water elevation data, groundwater quality data, and a description of the movement of groundwater and trends. ACWD prepares an annual Survey Report on Groundwater Conditions which summarizes the total well production, estimated recharge, and changes in groundwater storage for the period of reporting and includes forecasts for the various categories of groundwater pumping for the following year. It also includes a recommendation for the amount of supplemental water to be purchased in order to maintain basin water levels, which is presented to the Board of Directors. ACWDs groundwater management programs and activities have ensured adequate pressurization of aquifers, importation of purchased water when needed to supplement local water, basin-wide monitoring, mitigation of legacy saltwater intrusion, metering and administration of a replenishment assessment program as part of a basin management framework which has resulted in the operation and sustainable management of Niles Cone within its sustainable yield over the last five decades, including the most recent 10-year period from 2005-2015, as provided in the enclosed Niles Cone Sustainable Yield 10-Year Analysis. The last 10 Survey Reports on Groundwater Conditions have also been included. Additional documents and information about management of the Niles Cone is included in the Alternative Elements Guide and corresponding enclosed documents.

For over 100 years, Alameda County Water District (ACWD) has managed the groundwater of the Niles Cone Groundwater Basin through programs that protect and improve water supplies for all groundwater users and the environment. ACWD is identified in the Sustainable Groundwater Management Act (SGMA) as an agency created by statute to manage groundwater and deemed to be the exclusive local agency within its statutory boundaries with powers to comply with SGMA. In March 2016, ACWD submitted a Basin Boundary Modification Request to correct the northern boundary of the Niles Cone Subbasin 2-09.01 (Niles Cone), which was subsequently approved, as modified by DWR on July 1, 2016. DWR published the Final Basin Boundary Modification in October 2016. At the November 10, 2016, Board of Directors meeting, the Board adopted Resolution No. 16-069 deciding to become the Groundwater Sustainability Agency (GSA) for Niles Cone Subbasin 2-09.01. As an exclusive agency and a GSA, the District is required to submit an Alternative to a Groundwater Sustainability Plan (Alternative) or a Groundwater Sustainability Plan for the management of the Niles Cone Subbasin 2-09.01 under SGMA. ACWDs geographic area encompasses approximately 105 square miles. ACWDs groundwater statutory service area includes the City of Fremont, the City of Union City, the City of Newark, and the southern portion of the City of Hayward. ACWD also has groundwater protection authority throughout the entirety of the cities of Fremont, Newark, and Union City beyond the Niles Cone Subbasin 2-09.01, which extends west into the San Francisco Bay and east into the Diablo Range. This includes taking measurements, collecting data, including samples of groundwater and an assessment of well pumping and the use of groundwater. On December 8, 2016, ACWDs Board of Directors adopted Resolution No. 16-075 authorizing the submittal of an Alternative to a Groundwater Sustainability Plan for Niles Cone Subbasin 2-09.01.
