4. BRIEF DESCRIPTION OF POTENTIAL BASIN BOUNDARY MODIFICATION REQUEST
  • The Alameda County Water District was formed in 1914 for the purpose of protecting the water in the Niles Cone Groundwater Basin and conserving the water of the Alameda Creek Watershed. ACWD has been managing the Niles Cone Groundwater Basin pursuant to its statutory authority, as well as, through agreements with the cities of Fremont, Newark, Union City, and Hayward ever since then. In the most recent edition of DWR Bulletin 118 (2003), no physical changes of the Niles Cone Groundwater Basin (Subbasin Number 2-9.01) boundaries were made, as the text description continues to describe the boundaries of the Niles Cone Groundwater Basin as, "the southern portion of the east bay area bounded on the south by the Alameda-Santa Clara County boundary and the north by the boundary of Alameda County Water District (ACWD), and southern portions of the City of Hayward." However, the boundaries of the Niles Cone Groundwater Basin, as shown in the graphical map that accompanied Bulletin 118 (2003), does not match the textual description of the northern boundary as it does not extend all the way to the northern boundary of ACWD and does not include the southern portions of the City of Hayward, all of which ACWD manages. There are certain areas within the City of Hayward that were detached from ACWD in 1973, 2000, and 2004, when ACWD worked cooperatively with the City of Hayward to detach properties from ACWD as appropriate, in order for the City of Hayward to provide water service while ensuring that ACWD retained authority to manage the Niles Cone Groundwater Basin. ACWD is identified within the Sustainable Groundwater Management Act as an agency created by statute to manage groundwater and deemed to be the exclusive local agency within its statutory boundaries to comply with the Sustainable Groundwater Management Act (California Water Code Section 10723 et seq.). Since the basin boundaries in Bulletin 118 will now play a critical role in the management of California's groundwater basins, the graphical map needs to be accurate and consistent with the Bulletin 118 narrative documentation of the Niles Cone Groundwater Basin. On February 11, 2016, ACWD's Board of Directors adopted a resolution to begin the process to correct the northern boundary of the Niles Cone Groundwater Basin (see hyperlink provided above to see the resolution). Accordingly, ACWD plans to submit a request to the Department of Water Resources (DWR) for a basin boundary modification to ensure that the boundary line for the Niles Cone Groundwater Basin includes the entire groundwater basin area that ACWD has been managing since ACWD was formed over 100 years ago.
