AGSA Eligibility Determination

  1. Pursuant to Water Code Section 10723.8, the County of San Luis Obispo hereby notifies the California Department of Water Resources (DWR) of its decision to become a Groundwater Sustainability Agency (GSA), and its intent to cover the portions of the Paso Robles Area Subbasin ("Paso Basin") of the Salinas Valley Basin within the County's jurisdictional boundaries that are not otherwise represented by another GSA. This notice is submitted in compliance with Water Code Section 10723 (d). The County of San Luis Obispo is a local public agency organized as a general law County under the State Constitution and has land use responsibility for the unincorporated areas of the Paso Basin proposed to be managed under this GSA.

  3. The County intends to be the GSA over all areas of the Basin that are otherwise unrepresented by another qualifying local agency and are within the County's jurisdictional boundary. It is also the County of San Luis Obispo's intent that no overlap occurs with other GSAs forming within the Paso Basin. The County published legal notices in the local newspaper, the Tribune, on May 2nd and May 9th and held a public hearing on May 16, 2017. On November 19, 2019, the County Board of Supervisors held another public hearing, authorized certain changes to the GSA Boundary to align with specific updates to the Bulletin 118 Basin Boundary and Shandon-San Juan Water District GSA Boundary, and found the changes non-material. The shapefiles, staff report and resolution explaining the changes, was uploaded September 22, 2021. On June 6, 2023, the County Board of Supervisors, held a public hearing to adopt a resolution 1) withdrawing from serving as the Groundwater Sustainability Agency (GSA) within the Estrella-El Pomar-Creston Water District (EPCWD) service area through modification of the boundaries of the ?Paso Basin ? County of San Luis Obispo Groundwater Sustainability Agency?; 2) acceptance and approval of the ?Addition of Party to Memorandum of Agreement regarding Preparation of a Groundwater Sustainability Plan for the Paso Robles Groundwater Basin? signed by the EPCWD; 3) authorizing the Director of Groundwater Sustainability to take actions to effectuate the GSA boundary modification; 4) and find the project is exempt from Section 21000 et seq. of the California Public Resources Code (CEQA) and found the changes non-material. It is also the County of San Luis Obispo's intent that no overlap occurs with other eligible entities forming GSAs within the Paso Robles Groundwater Basin.
